- Prospective members can apply as individuals or a business, but in both cases MUST have an Australian Business Number (ABN).
- Applications are reviewed for alignment with the Institute’s values covered by the membership application questionnaire which covers ethical conduct and fairness in the Australian community considerations.
- Admission requires payment of a membership fee.
- Successful members receive a certificate and a digital badge to display.
- Membership of the FIOA is generally for a two-year period and a renewal notice is sent out approximately one month prior to membership expiry date.
- Members gain access to exclusive member marketing, resources and support to achieve and maintain their FIOA membership status.
- Introduction
These Terms and Conditions (“Terms”) govern your membership in Fairness Institute of Australia Pty. Ltd. (“the Institute,” “we,” “our,” “us”). By applying for or maintaining membership, you agree to these Terms.
- Eligibility & Application
- Membership is open to individuals or businesses committed to ethical conduct and fairness.
- Applicants must submit a membership application (Including questionnaire) via our website or designated channels.
- The Institute reserves sole discretion to accept or reject any application.
- Approval & Registration
- Membership begins on FIOA approval and payment received (notification via email).
- Applications are reviewed for adherence to our values, including fairness, ethics, and compliance with law.
- Approved applicants will receive a notification and an invoice for the membership fee.
- Fees & Payment
- Membership fees set by the Institute must be paid promptly upon approval and renewal of membership (within 7 days).
- Fees are non-refundable, except as required by law.
- Late payment may result in suspension or termination of membership.
- Membership Benefits
Upon payment, members are entitled to:
- A membership certificate and digital badge for display.
- Access to exclusive Institute resources, guidance, and support.
- Eligibility for “preferred status” and access to the members-only online shop featuring vetted goods and services.
- Member Obligations
Members must:
- Uphold the Institute’s values, maintaining fairness, integrity, and ethical conduct.
- Comply with all relevant Australian laws, regulations, and industry standards.
- Continuously improve practices and stay informed on ethical standards and fairness developments.
- Use of Membership Materials
- Certificates and badges are proprietary and should be used responsibly and may only be used when valid. Misuse may result in disciplinary action or termination.
- Privacy & Data Handling
Personal information is managed in accordance with Australian privacy laws and only used for membership administration, communication, and Institute-related purposes.
- Termination or Resignation of membership
- Members may resign membership at any time by written notice via email to the FIOA. Please email: admin@FIOA.com.
- The Institute may suspend or terminate membership for:
- Breach of these Terms or Code of Conduct or damage to the Institute’s reputation.
- Failure to pay membership fees.
- Termination may be immediate if serious misconduct arises.
- Following Termination or Resignation of membership, the said members details will be promptly removed from the FIOA website member search page.
- A pro-rata refund is available from the end of the current calendar month of the membership (cancellation month/year), to the end of the current membership period of the member (if cancelled with membership in good standing i.e. no serious breach identified). For example, if the membership was for 2 years starting 1 January 2024 and the membership was cancelled on 15 February 2025 then a pro-rata refund of membership of fees for 11 months can be requested.
- Note well that if a termination or resignation of FIOA membership occurs, under no circumstances may the member continue to use FIOA membership for business purposes, including use of the certificate or badge for their business. If an expired or terminated FIOA membership is continued to be used by the business on the evidence, the FIOA is entitled to seek injunctive relief to prevent a breach of this agreement and to compel specific performance of this agreement; and
- the member will reimburse the FIOA for all costs and expenses, (including legal costs and disbursements on a full indemnity basis to the relevant Australian legal tribunal or court) incurred in enforcing the member obligations under this agreement on the completion of legal action.
- Liability & Disclaimers
- To the extent permitted by law, the Institute is not liable for any loss arising from membership or participation in its services.
- Amendments
- The Institute may update these Terms from time to time and provide prompt notice to members with at least 7 days’ notice.
- Members will be notified of significant changes via email or in writing.
- Governing Law & Jurisdiction
- These Terms are governed by the laws of Queensland, Australia.
- Disputes will be resolved under the exclusive jurisdiction of courts in Queensland, including state and federal courts and tribunals.
Membership Code of Conduct
As a valued member of the Fairness Institute of Australia Pty. Ltd. (“the Institute”), you agree to uphold the following principles and behaviours. This Code is designed to maintain the integrity, professionalism, and fairness that underpin our Australian community.
- Upholding Fairness and Integrity
- Act honestly, ethically, and fairly in all dealings.
- Avoid conduct that could bring the Institute into disrepute.
- Respect for Others
- Treat all customers, staff, members and stakeholders with courtesy and respect.
- Value diversity, inclusivity, and constructive dialogue.
- Compliance with Law and Standards
- Comply with all relevant Australian laws, regulations, and industry standards.
- Always follow Institute policies and guidelines in relation to your membership application.
- Responsible Use of Membership
- Use membership certificates, badges, and digital materials responsibly.
- Do not misrepresent your membership or use it for misleading purposes.
- Contribution and Engagement
- Actively participate in Institute activities, events, and initiatives.
- Share knowledge, collaborate with peers, and promote the mission of fairness.
- Confidentiality and Privacy
- Respect the confidentiality of Institute website, content, records and FIOA Intellectual property in general.
- Protect member personal data in line with privacy obligations.
- Continuous Improvement
- Strive to uphold best practice in fairness, ethics, and professional conduct and in accordance with the FIOA membership application.
- Remain open to learning, feedback, and ongoing development.
- Accountability
- Take responsibility for your actions as a representative of the Institute.
- Cooperate with the Institute in resolving complaints or breaches of this Code from relevant stakeholders including customers, staff, suppliers and other third parties including relevant government and private bodies. E.g. ASIC, ACCC, Unions, Professional and Trade associations.
Non-Compliance
Breaches of the Terms and Conditions / Code of Conduct may result in disciplinary action, including suspension or termination of membership, as outlined in the Member Terms and Conditions.
A Serious breach of this agreement, as determined by the FIOA in its absolute discretion may result in full forfeiture of current membership fees. If such action is imminent, we will discuss this matter with you first before taking any action and consider your current circumstances and explanation.
